Please note that Cerbera Gallery does not provide in-house shipping for auction items. All packing, shipping, and handling of auction items are the sole responsibility of third-party shipping providers.

After a purchase, buyers must coordinate directly with their preferred shipper to arrange pickup and delivery. We are happy to provide a list of recommended local shippers upon request.

Terms & Conditions – Cerbera Gallery Auctions

Cerbera Gallery reserves the right, at its sole discretion, to deny participation in any auction to any bidder—whether bidding in person, online, by phone, or via absentee bid. For high-value lots, Cerbera Gallery may restrict or decline internet bidding. If you wish to bid on such items, please contact us directly or email us at info@cerberagallery.com well in advance.

Please note: bidder registrations will not be approved once the auction is underway. If your registration status shows as “pending,” you are not yet authorized to bid. To ensure approval, we strongly recommend contacting Cerbera Gallery at least 24 hours before the auction begins.


Conditions of Sale – Cerbera Gallery

By placing a bid, you acknowledge and agree that your bid may be treated as a binding offer to purchase the specific lot. If your bid is accepted by the auctioneer, you enter into a legally enforceable agreement to purchase the lot at the accepted bid amount.

You agree to take full personal responsibility for the payment of the purchase price, including the applicable buyer’s premium. Upon acceptance of your bid, you assume all risks related to the lot, including loss or damage, and are responsible for all associated costs, including but not limited to handling, shipping, insurance, taxes, and export fees.

All sales are final.
Missouri residents are subject to 9.9750% sales tax, unless a valid resale or tax-exempt certificate is provided.


Condition Statement – Cerbera Gallery

It is the responsibility of each bidder to fully understand the condition of any item before placing a bid. All lots are sold “AS IS”, without warranty or guarantee of any kind. Cerbera Gallery encourages prospective buyers to inspect items in person during the preview period prior to the auction.

While we may provide condition reports upon request, these are offered strictly as a courtesy and should not be interpreted as a guarantee or comprehensive assessment. No statement, written or verbal, made at any time regarding the condition, value, origin, or quality of any item shall be considered a warranty. **All sales are final. No refunds, returns, or cancellations will be accepted on the basis of condition—**no exceptions.


Important Notices

Cerbera Gallery typically conducts live auctions at a fast pace. Internet connectivity issues may cause delays in bid transmission. To avoid missing out, we recommend placing realistic absentee bids in advance as a safeguard.

Internet bids are not visible to us until the lot opens on the auction floor. Due to latency, floor bids often take precedence. Floor bids will be given priority over internet bids in the event of simultaneous offers.


Breach of Agreement

Failure to comply with payment or any terms listed herein may result in one or more of the following actions by Cerbera Gallery:

  • A) Canceling the sale of the lot and any other lots won by the same buyer.
  • B) Reselling the item publicly or privately, with or without reserve, and retaining any payments already made.
  • C) Filing a civil complaint after 30 days to recover outstanding balances, court costs, interest, storage fees, and damages.
  • D) Charging 1% interest per month on overdue balances.
  • E) After 45 days, reselling the item(s) and pursuing the original buyer for any remaining balance and associated costs.

Post-Auction Notifications

Invoices are typically sent via email within 72 hours of the final auction session. Please ensure your contact information is accurate and check your spam folder if you don’t receive your invoice promptly.


Payments

Cerbera Gallery charges a 3.5% buyer’s premium added to the hammer price for all purchases paid via check, money order, or wire transfer.

Payments made via CREDIT CARD will incur an additional 0% processing fee. The processing fee is covered by the buyer’s premium. It is advisable to notify your card issuer in advance to avoid authorization delays. Purchases will only be released upon confirmation of cleared payment.

Online Bidding Disclaimer

Cerbera Gallery accepts no liability for delays, failures, or errors associated with any online bidding platform. Online bidding is provided “as is” without any warranties—express, implied, or statutory. This includes but is not limited to issues related to platform availability, software or hardware defects, or internet connectivity problems.

Your participation via third-party platforms is solely at your own risk, and we strongly advise you to read and understand their terms and privacy policies. Cerbera Gallery and its consignors will not be held responsible for any losses or damages resulting from the use of these services.


Authenticity Guarantee (Limited)

While all property is sold as-is, in the event that an item is proven to be counterfeit, Cerbera Gallery will offer a full refund of the purchase price, provided that:

  • Written notice is given within 14 days of the sale.
  • The lot is returned within 10 days of that notice in the same condition it was sold.
  • The buyer provides satisfactory proof of the claim.

This guarantee applies solely to authenticity and does not cover any other aspects of condition or provenance.
